This is Stillwhite’s Policy on copyright and notification of alleged intellectual property infringements (IP Infringement).

1. Our policy

1.1 Stillwhite respects the intellectual property rights (IP Rights) of others and expects its users to do the same.

1.2 You must not use copyright material, including photographs, without prior written approval from the Intellectual Property Owner (IP Owner) or use material, including photographs, that do not accurately represent the item for sale. If you are using material created by someone else, make sure you have prior written approval from the IP owner.

1.2 It is Stillwhite's policy, in appropriate circumstances and at its sole discretion, to remove the alleged infringing material from the platform. Stillwhite may, in its sole discretion, suspend, disable and/or terminate the account or access of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other IP Rights of others or the removal of the alleged infringing material from the platform.

2. Working with IP owners

2.1 Stillwhite will respond to claims of IP infringement committed using the Stillwhite platform that are reported to Stillwhite in accordance with this Copyright Policy.

2.2 If you are an IP owner, or are authorised to act on behalf of an IP owner, please report alleged IP infringements taking place on or through the platform by following the Notice of Alleged Infringement as described below.

3. Notice of Alleged Infringement

3.1 If an IP owner, or an authorised person to act on behalf of an IP owner, wishes to notify Stillwhite of any alleged IP infringements on the platform, please serve a written Notice on Stillwhite which contains the following (Notice):

  1. identify the specific copyright material that you claim has been infringed, or - if there is multiple copyright material - you may provide a list of the copyright material that you claim have been infringed.

  2. identify the copyright material that you claim has been infringed (or to be the subject of infringing activity) and outline the reasons why you believe the copyright material should be removed from the platform or access to which should to be disabled, and information reasonably sufficient to permit us to locate the copyright material, including at a minimum, if applicable, the URL of the link shown on the platform where such copyright material may be found.

  3. include both of the following statements in the Notice:

    • "I hereby state that I have a good faith belief that the disputed use of the identified copyright material is not authorised by the IP owner, its agent, or the law (e.g., as a fair use)."

    • "I hereby state that the information in this Notice is true and accurate and I am the IP owner, or authorised to act on behalf of the IP owner, of the IP Rights that are allegedly infringed."

    • "I indemnify Stillwhite against any claim, loss, damage, liability, cost or expenses that may be incurred by Stillwhite any action taken by Stillwhite against the user as a result of this Notice and/or any warranties contained herein not being true and accurate."

  4. provide your full legal name, email address and contact number and your electronic or physical signature.

3.2 Please deliver the Notice, containing the requirements as set out above, to Stillwhite at support@stillwhite.com

3.3 Upon receipt of the Notice, Stillwhite will take whatever action, in its sole discretion, it deems appropriate, including the removal of the alleged infringing material from the platform or the suspension, disablement or termination of an account, including access to the platform. Stillwhite’s determination on whether the material is permitted or not will be final and conclusive.
